Private Sale Transfers are easy to do at East Lincoln Guns. We help buyers and sellers comply with current federal and state regulations regarding the sale, and legal transfer of firearms. The process is fairly simple.

 

  1. Both buyer and seller work out a beneficial agreement for the sale of the firearm prior to coming to East Lincoln Guns for transfer. Buyer inspects firearm.

  2. Buyer and Seller meet at East Lincoln Guns for Transfer. Seller verifies the firearm magazine is empty, and action is clear/unloaded.

  3. The buyer provides required identification, pays for the background check fee and fills out the ATF Form 4473, and background check is initiated through the federal FBI-NICS system.

  4. Once a ‘proceed’ indication is received from the federal FBI-NICS system, the process will continue in item 5. If a 'denial' is received, the process ends here. If a 'delay' is received, the process is restarted when a 'proceed' indication is received from FBI-NICS. East Lincoln Guns will contact both buyer and seller once a 'proceed' indication is received. If the process takes more than 29 days from initiating background check, a new ATF Form 4473, and Background Check is MANDATORY.

  5. The seller submits the firearm and their identifying information to East Lincoln Guns for cataloging.

  6. Next, the firearm information is entered on the ATF Form 4473, and the firearm is transferred to the buyer.

  7. Buyer is responsible for the total transfer fee as listed in the schedule of fees. The background check fee will be used as a credit toward the total fee due for transfer.

 

The easiest way to facilitate this process is to have both buyer and seller present at East Lincoln Guns at the time or transfer. If desired, the seller may leave the firearm at East Lincoln Guns, but federal regulations have to be followed regarding acquisition of firearms by a dealer. Once an item is catalogued and entered into a system, an ATF form 4473 must be initiated to retrieve the firearm out of inventory. This means that if the buyer does not pass a background check, the seller must fill out the form 4473 in order to retrieve the firearm from inventory. This requires a background check. After the proceed indication is received from the federal nics system, the seller is then required to pay the transfer fee as listed in the schedule of fees. Any firearms left at East Lincoln Guns for a period of over 30 days without prior arrangements will be considered abandoned, and become property of East Lincoln Guns. Buyer and Seller agree, that as a condition to performing the Private Sale Transfer, that East Lincoln Guns does not warranty the appearance, durability, accuracy, authenticity or function of any firearm that is transferred through private sale. Buyer and Seller agree, that as a condition to doing the Private Sale Transfer, that East Lincoln Guns will not be held liable for the responsible use of firearms acquired during private sale transfers.

 

The cost for the Private Sale Transfer is tiered. Basic transfers cost $25 which covers one firearm. When multiple items are concerned, the second and subsequent long-guns $10. Second and subsequent Handguns are $20 (due to additional mandatory documentation required- when 2 or more pistols purchased in less than a 7day window). Mississippi Firearms Permit holders receive $5 discount on their transfers as long as the permit is VALID, and has CORRECT ADDRESS information on it.
